This offer (the “Offer”) valid only from Janurary 1, 2018 through December 31, 2018. The Offer is valid only for existing customers who have either made a purchase from www.MyAqua.ca or created an account on www.MyAqua.ca (each a “Referring Customer”, “you” or “your”). Not valid with any other offers or discounts. 

To participate, you can refer friends who have not previously made a purchase on www.MyAqua.ca (each a “Referred New Customer”) by sending them your discount code created by you as the recipient of this invite-only Offer. Each Referred New Customer you refer who uses your discount code will receive a discount on Magic MINZ (the “Referred New Customer Reward”), as specified in and in accordance with the terms provided in the offer to the Preferred New Customer (the “New Customer Offer”).

Once a Referred New Customer uses your discount code and makes a purchase at www.MyAqua.ca on Magic MINZ, excluding taxes and shipping charges (the “Minimum”), MyAqua will confirm the Qualifying Purchase and, seven (7) days after each Qualifying Purchase is completed, with payment received by MyAqua, MyAqua will credit your account or give you a reward, as set out below. When the credit has been placed in your account, or a reward has been sent to you, MyAqua will send you an email letting you know that this action has taken place.

During this limited time Offer, each Referring Customer will receive, as determined in MyAqua sole discretion, either (i) a credit, in the amount specified by MyAqua in writing (for use only on Magic MINZ on www.MyAqua.ca) for each Qualifying Purchase made by a Referred New Customer or (ii) a reward, as specified by MyAqua in writing, for each Qualifying Purchase made by a Referred New Customer (each a “Referral Reward”). You may receive no more than a total value of $5,000 in Referral Rewards in your lifetime, and agree, by participating in the Offer, that you will not claim more than such amount in Referral Rewards from MyAqua.

If a Referred New Customer returns a purchased item and their corresponding order value decreases to below the Minimum, any unused Referral Reward awarded to the Referring Customer may be rescinded. Referring Customers may not refer anyone who is an existing MyAqua customer, including an existing customer with an account under an alternate email address. You agree not to use spam or to send unsolicited emails to persons you do not personally know to collect referrals. You agree not to collect referrals by posting on message boards or other public venues, online or offline. You agree not to obtain referrals through any fraudulent or misleading activity (for example, by referring fake people to MyAqua, using false names, using multiple identities, email accounts or email addresses, impersonating another person, or otherwise providing false or misleading information, to MyAqua or to potential Referred New Customers) MyAqua may also cancel or rescind a Referring Customer's Referral Reward if MyAqua terminates the Referring Customer's account for any reason. MyAqua reserves the right to cancel or rescind a Referring Customer's Referral Reward if it determines in its sole discretion that a Referring Customer has violated these terms. Any other abuse of this Offer, as determined by MyAqua in its sole discretion, may result in the rescission of the Referring Customer's Referral Reward and cancellation of the Referred New Customer's discounted order, as well as a determination that either or both parties are ineligible to participate in these or future offers. Determination of referral eligibility and Qualifying Purchases, as well as any exceptions, are at the sole discretion of MyAqua. MyAqua reserves the right to verify and adjust Referred New Customer Rewards and Referral Rewards at any time prior to or following posting and redemption.

Neither Referred New Customer Rewards nor Referral Rewards can be applied to previous purchases, and neither is redeemable for cash or distributed for anything else. This Offer not transferable, and is subject to modification, suspension or termination at any time without notice in MyAqua's sole discretion. The most recent terms of this Offer posted on www.MyAqua.ca will be binding on you and MyAqua.

The Offer is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

You agree to hold harmless and indemnify MyAqua, its agents and representatives against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) your participation in the Offer; (ii) the receipt or use of the Referral Rewards; or (iii) the administration of the Offer.

You hereby release, waive and discharge any and all claims of damage, loss or causes of action which you or any of your representatives, heirs, next of kin or assignees may have or which may hereinafter accrue to such persons against MyAqua, its agents and representatives as a result of your participation in the Offer or the receipt or use of the Referral Rewards.
